This website is operated by HEREUEXIST Limited. These Terms and Conditions of Sale (Terms of Sale) apply whenever you order any product through our website www.madeforhue.com (the ‘website’). This policy should be read alongside and is in addition to, our Privacy, Data Protection and Cookie policy. 

 

Please read these Terms of Sale carefully before accessing our website and purchasing any goods. By visiting our site and/ or purchasing one of our products, you agree that you have read, understood, and agree to these Terms of Sale. If you do not agree to these Terms of Sale, you must not order any product from us. If you are purchasing or have purchased HEREUEXIST Products from a third-party, these Terms of Sale will not apply, and you should refer to the Terms and Conditions of Sale of the relevant party. 

 

You can review the most current version of this Terms of Sale at any time on this page. We reserve the right to update, replace or change any part of this policy by posting changes and/ or updates to our website. It is your responsibility to check this page for changes. Continued use of our access to the website following any changes constitutes an acceptance of these changes.

HEREUEXIST Limited (referred to in these Terms of Sale as ‘HUE’, ‘we’, ‘us’ or ‘vendor’ ) is a company registered in the United Kingdom and whose address is Second Floor, 11 Berkeley Street, London, W1J 8DS. 

Scope of Acceptance 

The site www.madeforhue.com (hereinafter referred to as the “Site”) is an e-commerce site. It is open to any user (hereinafter referred to as “User”).  Under these Terms of Sale, it is agreed that the User and Vendor shall be jointly referred to as the “Parties”, and individually as a “Party” and that a User that has confirmed an order shall then be referred to as the “Customer”.

The rights and obligations of the User shall automatically apply to the Customer. It is stipulated that the User may make a backup copy or print these Terms of Sale, providing that they are not modified.

The Vendor reserves the right to change these General Terms of Sale without notice and at any time, with any modifications not applying to reservations and orders already accepted and confirmed. These Terms of Sale shall apply to the exclusion of any other document.

About you 

 

By ordering products from us, you confirm that you are aged 18 years or over.  You are legally capable of entering into binding contracts and are purchasing the Products for personal and non-business use. 

Products sold on the site

All the offers of the products proposed on the site are limited to www.madeforhue.com. Purchase offers, including sales and special promotions, are valid for as long as they are visible on the Site.Free shipping may be available for orders over a minimum purchase price during promotional periods. HUE reserves the right to limit this promotion to certain international destinations. Free shipping will only apply to standard shipping options and not include any express or 1st class delivery options. Changing your delivery address, speed, or preference might affect your order's eligibility for free Delivery. HUE reserves the right to change or discontinue free shipping at any time. Please note for free shipping promotions, the return delivery fee will be at the customer’s expense.

 

Please note that all sales and promotions are subject to stock availability. In the event we are out of stock on certain sale products, the offer will be removed or refreshed accordingly. 

HUE reserves the right to cancel an order(s) in the event of promotional misuse or suspected suspicious activity. The customer will be informed of the cancellation. If you obtain a product on your order for free due to a technical error, you are obliged to either return the item or pay the full value of the item. 

With additional free or gifted items from HUE, we are not liable for variation between product image and actual product. Said items are solely recognised as a token of appreciation and will not be valued.  These items will not be subject to uniform conformity of advertised images on the HUE website.

Product descriptions

 

All product images and descriptions shown on the Website are provided for general information. Product images are intended as guidance only, and actual Products may vary. The packaging of the product may vary from that shown in images on our website. Although we have made every effort to display our products accurately, we cannot guarantee that this displays the products accurately. 

Although our skincare products are specially designed and tested to improve your skin, they are not intended to treat, cure or prevent any condition or disease. All products should be used strictly in accordance with their directions of use, cautions, patch testing, storage and expiry. You should always check the ingredients of products to avoid potential allergic reactions. Use of our products, and/or website, is not meant to be used as professional medical advice. If you have any personal concerns, please consult with your healthcare practitioner or physician regarding the use of any products or information on our website before use.  

Product pricing 

The prices shown on the Site are in Pounds Sterling (£GBP), with the stipulation that products are invoiced at the price in force when the order is registered. 

They do not include shipping charges which are invoiced in addition to the price of the purchased products. Shipping charges will be shown before the Customer is asked to confirm the order. 

Prices include value-added tax (VAT), at the rate in force on the day of the order and any change in the applicable rate will be automatically reflected in the price of the products on the website. 

All prices shown on the Website are subject to change without notice. If the price of your Products has changed after you have ordered, we will not be able to refund/credit you the difference in price. We reserve the right at any time to modify or discontinue any products without notice.

Products availability 

All products are subject to availability. We list availability information for products sold by us on our website. Please note that customers cannot currently order products listed as being out of stock. We will inform you as soon as possible if the products you have ordered are not available. We reserve the right to cancel your order and issue you with a refund if your order is processed and the product is subsequently found to be out of stock. 

Reservation of Ownership

The Products ordered shall remain the property of HUE until complete payment of their value, including the main value of Products, as well as any costs and taxes included in the invoice/receipt, and the applicable delivery costs.

Conditions of order

HUE only sells Products via the Website to Consumers. Products are solely intended for the Customer’s personal use, excluding any connection to his/her professional capacity. As a consequence, any order exceeding six (6) units bearing the same reference shall not be accepted as it is not presumed to correspond to the consumption and personal use of a Customer.

In the event of an order of Products exceeding this maximum, the order shall be considered null and will not be taken into account by HUE. The same would apply if the Customer orders more than 6 (six) units of the same product in subsequent orders over a short period of time.

Order Confirmation

Upon completing an order, you have now entered a legally binding contract with HUE. This will then be confirmed by written confirmation in the form of an email and order confirmation. 

Payment

During the checkout process, you will be asked to complete your payment details. Our payments are handled by Shopify payments.  All required fields must be completed, these would be flagged with an asterisk. We accept most major debit and credit cards. Please note Shopify payment will keep your information private. How payment information and confidential details of customers will be stored by 3rd parties can be found on their website and HUE is not privy to this. 

All card payments must be authorised by your card issuer. If your payment is not authorised, we will cancel your order and notify you in writing via email. If you have already received the products you ordered from us, you must return them. This return will be at the customer’s expense. If we cannot supply you with the Product that you have ordered, we will cancel your order and inform you of this as soon as reasonably possible. We will give you a full refund in the case that you have already paid for the Products. Legal ownership of the Products will immediately revert to us if we refund any such payments to you.

Order Delivery

The products will be delivered to the address provided by the Customer when placing their order according to the selected method of delivery.

Orders will be delivered as from the day on which the Vendor receives the order, according to the selected method of delivery and no later than 30 days as from reception of the order, subject to full payment of the price. International shipping may vary.

Order cancellation 

We kindly ask that you review your order carefully before placing it to ensure that all information and contents are correct. Please be advised that once an order is placed, it cannot be modified or cancelled.

We cannot guarantee cancellations, but we will try our best to accommodate in exceptional circumstances. If you would like to request a cancellation, please email at hello@madeforhue.com. Please note, we have very limited support on weekends and public/bank holidays.

Receipt

On receipt of the Products, the Customer undertakes to check the good condition of the packaging and the conformity of the Products delivered with the order and inform HUE of any error, damage to packaging, or non-arrival as soon as possible.

In the event that the Customer reports a missing product or a delivery delay, HUE will make enquiries with courier providers including, but not limited to, Royal Mail, UPS and DHL.

In case of a missing product, should said product be found before the indicated delivery date, the product will be redirected to the delivery address specified in the order form.

If the order or the missing product has not been delivered after the indicated delivery date the Customer shall write to HUE via email.

If the delivery is not carried out within a reasonable additional time, the Customer can cancel the Contract by making a statement to that effect, by any means including email or using the contact form available on the Website. The Contract shall be deemed to be cancelled upon receipt by HUE of the Customer's request informing of his/her decision (unless HUE has performed in the meantime). In such a case, all the sums paid by the Customer (including delivery charges) will be returned to the Customer as a reimbursement as soon as possible and no later than 14 days from the date on which the Contract was cancelled.

 

International shipping disclaimer 

As we are a UK based company, when a package is shipped internationally, it may be subject to import taxes, customs duties and/ or other fees imposed by the destination country. These charges are not included in the product price or shipping costs.  Please note for customers ordering to Europe (EU) any customs or duty fees will be applied at checkout. All other  international customers are responsible for all customs and duty fees that are incurred during transit, these fees will not be applied at checkout. For all non-EU customers HUE  does not have any responsibility on these additional charges that may apply. These charges are the customer's responsibility.

Legal Guarantee

The customer shall benefit from the provisions of the legal guarantee regarding product conformity. In the event of non-conformity, due to a defect which exists at the time of delivery or an error affecting the product. The customer can choose to return the product and be reimbursed. Return shipping costs will also be reimbursed by us on request. Please contact our Customer Services by email with regard to any claim. 

Warranties

You warrant to us that:

(a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;

(b) the information provided in your order is accurate and complete;

(c) you will be able to accept delivery of the products.

Withdrawal

The customer has a period of 14 days after receipt of the order, to return the ordered products for reimbursement. This return delivery fee will be at the customer’s expense. 

The reimbursement will be made to the original payment method. We endeavour to reimburse as soon as possible, but no longer than 14 days after receiving and accepting the return. This reimbursement will be subject to your own bank's processing times. 

** Please note that any delivery fees made towards Refunds and Returns must be made by the customer and HUE will not be responsible for this charge. **

Retention of Title

All products remain the exclusive property of the HUE until such a time as payment of the sale price, including the item, extra costs and taxes has been made in full.

Liability

 

A foreseeable event or situation is one that can be known about or guessed before it happens. If HUE fails to comply with these General Terms and Conditions of Sale, it will be responsible for loss or damage suffered by the Customer that is a foreseeable result of HUE breaking this Contract. 

HUE is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both Parties knew it might happen.

HUE does not exclude or limit in any way its liability to the Customer where it would be unlawful to do so. This includes liability for death or personal injury caused by HUE negligence or the negligence of HUE’s employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of the Customer’s legal rights in relation to the Products. Beyond this, HUE is not liable for any other type of inconvenience or material loss. 

HUE is not liable for business losses. HUE only supplies the Products for domestic and private use. If the Customer uses the Products for any commercial, business or resale purpose HUE will have no liability to the Customer for any loss of profit, loss of business, business interruption, or loss of business opportunity.

HUE makes no warranties that the Website will be available on an uninterrupted, timely, secure or error-free basis. Especially, HUE shall not be responsible for:

• Interruptions, malfunctions, or delays recorded on the Website due to technical failures, because of third parties or any circumstances beyond HUE’s reasonable control.
• The impossibility or temporary inability for the Customer to access the Website, due to circumstances which are beyond HUE’s control, such as computer breakdown, interruptions of the telephone network, the Internet, or the failure of the Customer's reception equipment for the Internet.

HUE reserves the right to suspend access to the Website at any time.

Packaging and delivery of HUE products are managed by a third party. 

Intellectual Property 

In accordance with legislation governing the ownership of literary and artistic rights, or other similar rights, this Site and all the elements, brands, drawings, models, photographs, texts, illustrations, logos and sequences whether animated or not, and with or without sound, graphics, etc., to be found in this site, together with their compilation, are the exclusive property of HUE, as it does not grant any licence or any entitlement other than that of consulting the Site. Any use or reproduction, in whole or in part, of these elements is authorised exclusively for information purposes only for personal and private use, with any reproduction and any use of copies made for other purposes is expressly prohibited. Neither the Site (in whole or in part) nor its content or brands may be used, reproduced, duplicated, sold, resold, made accessible, modified or exploited in any other way, in whole or in part, for any purpose whatsoever, without prior, written authorisation from the HUE.

Applicable Laws

These terms are governed by English law. In the event of any matter or dispute arising out of or in connection with these Terms, both the customer and HUE  shall submit to the exclusive jurisdiction of the English courts. 

Force Majeure Events

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any circumstances not foreseeable at the date of the contract and not within our reasonable control including, without limitation, strikes, lockouts, shortages of labour or raw materials, computer software failure (including but not limited to computer viruses), computer hardware failure, civil commotion, riot, invasion, war, threat of or preparation for war, terrorist attack, fire, explosion, storm, flood, extreme weather conditions, earthquake, subsidence, epidemic or natural physical disaster.

HUE’s performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. HUE will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
